Buyer New Home Construction Visit Policy

 

  

 

All parties, the builder, Keller Williams and the Mark Will Team, who are involved with your new home real estate transaction understands how exciting this experience is going to be for you and therefore understands your curiosity to visit your new home as it is under construction.  Keeping this in mind the builder has instituted the following criteria which buyer(s) must agree to follow when it comes to visiting the new construction site:

 

A.     Visits must be outside of the builders normal business hours of  7:00am-5:00pm Monday-Saturday. 

      Visits while contractors are on site can be distracting, dangerous and could lead to a slowing down or     

      stoppage of their work which potentially could cause a delay in your scheduled settlement.

  B.  All visits to the site must be in the presence of a licensed real estate agent, preferably your buyer's agent.

  C.  Hard hats will be available at the site and must be worn at all times when visiting you new home project.

D.     All builder's homes will be locked and secured after the installation of doors and windows, therefore,

         to gain entry, all visits must be approved in writing with 24 hour notice by the builder/seller. 

 

This policy is in place for several reasons to include protecting the builder's property from damage, theft, vandalism and to ensure the integrity and safety of your future new home.   The builder will carry liability insurance on builder's homes until settlement, at which time ownership of the home changes to the buyer(s).  The builder reserves the right to be the sole authority to grant entry to all who requests it and the use of any lawful remedy to discourage unauthorized, unlawful entry. 

In the event the buyer(s), their agents, invitees, guests or representatives do enter upon the Premises pursuant to the terms described herein, the undersigned, intending to be legally bound hereby, do hereby release and forever discharge, and agree to hold harmless and indemnify the builder, Keller Williams, The Mark Will Team,  each and all of them, and their officers, directors, employees, agents and affiliates, heirs and assigns, from and against any and all liability, causes of action or damages of any nature whatsoever, including expenses, costs and attorneys fees, which may arise out of, or in connection with, or as a result of any entry upon the Premises as aforesaid.  Furthermore, the undersigned shall indemnify and hold the builder, Keller Williams, The Mark Will Team,  each and all of them, and their officers, directors, employees, agents and affiliates, heirs and assigns harmless from and against any losses, damages, claims, requests for contribution, liabilities, obligations, costs, and expenses (including reasonable attorneys’ fees) arising out of any claim by any other third party whatsoever arising out of or relating to any entry upon the Premises as aforesaid.
